A previously unpublished draft of Donald Trump’s Gaza plan is causing new criticism: According to a report by the British “Guardian” want to grant far-reaching legal immunity – although the body has not yet exercised any executive control in the Gaza Strip.
The case is politically sensitive because the Board of Peace is at the center of Trump’s post-Gaza war plan. The UN Security Council adopted a US-backed resolution in November 2025 that welcomed the establishment of the body and authorized an international stabilization force for Gaza. However, it is still completely unclear whether and how Trump’s ideas for sustainable peace in the region will be implemented.
Criticism also of the real estate clause
According to the Guardian, the newspaper has a four-page draft that is marked as “sensitive but not secret”. It seeks to protect members of the Board of Peace, staff of an affiliated office of the High Representative, international forces, Palestinian administrative staff and outside contractors from arrests, detention and trials in the Gaza Strip.
According to the report, it is unclear whether the draft also targets proceedings before international courts. Particularly explosive: The draft stipulates that Trump, as chairman of the committee, could lift immunity – but only with the support of a majority in the “Peace Council”.
Another clause also causes criticism. Accordingly, public buildings and facilities in Gaza should be made available to the board free of charge. Lawyers see this as a danger that Palestinian property could be used or confiscated without a clear legal basis.
Lawyer: Committee wants to “avoid responsibility”.
Emily Schaeffer Omer-Man, who specializes in international humanitarian law, spoke to the Guardian of an attempt to escape the body and its employees from possible legal responsibility. International lawyer Noura Erakat said the draft creates “a separate legal system” without external control.
The governing body includes Trump’s son-in-law Jared Kushner, special envoy Steve Witkoff, chief of staff Susie Wiles and national security adviser Marco Rubio.
The Board of Peace rejected the representation. There is no valid resolution and no immunity model in the form described, a representative told the Guardian. The claim that Trump will play a role in establishing or removing immunity in Gaza is “categorically false.” At the same time, it remained unclear how exactly control and accountability for those involved should be regulated.
