Marius Borg Høiby has been in custody for over four months. Now a court has made a decision – but the matter is not yet over.

Marius Borg Høiby is in custody, Mette-Marit is waiting for a new lung. Now a decision was made. Your son could soon leave prison. On June 5, 2026, the Norwegian Royal Palace announced that the Crown Princess needed a lung transplant. One day before the official announcement, the 29-year-old had applied to be released from custody so that he could be with his mother. The request was rejected.

The Oslo court has now reheard the case and made a decision, as the Norwegian newspaper VG reports. The court granted the request. Marius Borg Høiby should be released. In its reasoning, the court stated that further detention would “represent a disproportionate interference with Høiby’s privacy”. The risk of relapse is “still low in the current situation”. And further: “Continued imprisonment would, however, be a significant burden not only for Høiby, but also for his mother in her already difficult situation.”

Marius Borg Høiby himself spoke at the hearing. According to the Norwegian magazine “Se og Hør” he justified his request with the words: “Knowing that mom is so sick is unbearable.” And he added: “My family’s situation is difficult enough as it is. I want to get out to be there for my mother, who is seriously, seriously ill.”
His defense attorney Petar Sekulic told VG that the key difference from previous applications was the mother’s health. “Every Sunday when we see each other, it could be the last time,” says Høiby. It has been publicly known since 2018 that Mette-Marit from Norway suffers from chronic pulmonary fibrosis.
If released, Høiby had announced that he would move back into his childhood room on Skaugum, together with his siblings. The public prosecutor’s office has appealed the verdict and challenged the decision. Until the appeal court examines the case, Høiby will remain in custody.
